Eminent Domain Reporting Begins November 1, 2018 for the 2019 Report Year

Senate Bill 1812 by the 2015 Texas Legislature requires all entities with eminent domain authority to report specific information to the Texas Comptroller on a yearly basis. The first report was due by Feb. 1, 2016. All entities with this authority, including water and wastewater supply corporations, water districts and cities, are required to file this yearly report or face penalties of up to $2,000 for noncompliance.

If an entity fails to report by the February 1, 2019 deadline, the Comptroller will notify the entity it has 30 days to report or be subject to a civil penalty of $1,000. If the entity does not report within another 30 days after the initial notice, the Comptroller will issue another notification with an additional $1,000 penalty.


Texas Rural Water Association offers an eminent domain filing service to assist systems with state mandate. The fees for this service are as follows:

TRWA Member: $100

Non-member: $150

A condemnation under Texas Property Code Section 21.012 is a condemnation in which a utility acquires real property for public use, but is unable to agree with the property owner over the amount of damages.

(Only answer yes if the system a petition in an appropriate local court as part of an eminent domain proceeding.)


TRWA will bill the system for this service
By clicking below, I hereby authorize Texas Rural Water Association to invoice our utility $100 (TRWA Member) or $150 (Non-Member) fee for subscribing to the TRWA 2018 Eminent Domain Filing Service.    I agree to have TRWA file as a third party on behalf of  our utility in the Texas State Comptroller Eminent Domain Database by  Feb. 1, 2018, in compliance with Government Code Chapter 2206, Subchapter D. TRWA relies on information provided by subscribing utility and TRWA will assume no responsibility or liability for false or misleading information provided by the utility regardless of whether the information was provided in error. Subscribing utility shall indemnify TRWA from and against any and all claims, causes of action, liabilities, costs, penalties and damages that may be asserted by or filed against TRWA or subscribing utility based on false or misleading information provided to TRWA by subscribing utility.
