Compliance with USDA Limited English Proficiency Requirements
Recently, USDA – Rural Development (RD) has adopted a provision that requires all current and intended borrowers of funds from the USDA – RD to examine the services provided, identify any need for services to those with Limited English Proficiency (LEP) and develop and implement a system to provide such services to enable persons with LEP to have meaningful access to RD funded programs.
USDA – RD has been sending out compliance notices to systems regarding the requirements, and enforcing that systems have a LEP policy in place. A sample notice may viewed here. Systems must respond within 30 days of the system's receipt of the notice. Your response should include a copy of your completed LEP plan, which can be mailed to your area USDA – RD office.
To help systems comply with this requirement, we have provided a sample LEP plan for systems to adapt and use for their own needs. This example has been determined to meet this request and accepted by USDA – RD.
